These terms govern your use of Adyzoom's services, including Meta/Google ad management and WhatsApp automation for real estate agents, brokers and builders. By engaging our services, you agree to these terms.

Our services

Adyzoom sets up and manages digital advertising campaigns and WhatsApp-based lead automation on your behalf. Services begin after a setup fee and/or agreed engagement is confirmed.

Initial engagement period

New clients begin with a 30-day initial engagement, payable as per the agreed setup fee and monthly retainer. There is no long-term lock-in — either party may choose not to continue after this period without further obligation, subject to any setup work already completed.

Fees and payment

A one-time setup fee covers ad account and automation setup.
A monthly retainer covers ongoing campaign management.
Advertising spend (paid to Meta/Google) is separate from our fees and is paid directly by you through your own ad account.
Fees are due as agreed at the start of the engagement and are non-refundable once work has begun, except where otherwise agreed.
If payment is delayed beyond 7 days of the due date, we may pause campaigns and automation until payment is received, without liability for any resulting loss of leads or bookings.

No guarantee of results

While we work to generate quality leads and enquiries, we cannot guarantee a specific number of leads, bookings, or sales. Results depend on factors including ad platform policies, market conditions, property pricing, and your team's follow-up.

Ad account compliance

You are responsible for ensuring your business and listings comply with applicable real estate laws in your jurisdiction (such as RERA in India, or equivalent regulations elsewhere). We follow Meta and Google's advertising policies when setting up campaigns, but platform decisions on ad approval or account status are made solely by Meta/Google.

Client responsibilities

Providing accurate property, pricing, and contact information.
Timely follow-up with leads passed on as qualified.
Access to ad accounts and any assets needed to run campaigns.

Indemnity

You are solely responsible for the accuracy and legality of the property listings, pricing, and claims used in your campaigns, including compliance with real estate regulations applicable in your jurisdiction (such as RERA in India, or equivalent bodies elsewhere). You agree to indemnify Adyzoom against any claims, penalties, or losses arising from inaccurate, misleading, or non-compliant listing information you provide.

Intellectual property

Ad creatives, posters, and automation flows built for you are yours to use for your business once fees are paid in full. Adyzoom retains the right to reuse general templates, frameworks, and non-client-specific processes across other clients.

Force majeure

Adyzoom is not responsible for delays or service interruptions caused by circumstances beyond our reasonable control, including platform outages, policy changes by Meta/Google/WhatsApp, internet or power outages, or other events outside our control.

Limitation of liability

Adyzoom is not liable for indirect or consequential losses, including lost profits, arising from campaign performance, platform actions, or third-party service interruptions. To the maximum extent permitted by law, Adyzoom's total liability for any claim arising from this engagement is limited to the fees paid by you in the month immediately preceding the claim.

No warranty

Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding uninterrupted service, error-free operation, or the accuracy of third-party platform behavior (including Meta, Google, and WhatsApp).

Termination

Either party may terminate the engagement with notice as agreed at the time of onboarding. Fees for work already completed remain payable. Adyzoom may suspend or terminate services immediately, without notice, in cases of non-payment, abusive behavior towards our team, or use of our services for illegal, fraudulent, or misleading purposes.

Confidentiality

Both parties agree to keep confidential any non-public business information shared during the engagement, and not to disclose it to third parties except as required by law.

Changes to these terms

We may update these terms from time to time. Continued use of our services after an update constitutes acceptance of the revised terms. Material changes will be communicated to active clients where reasonably possible.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Eligibility

Our services are intended for businesses and individuals aged 18 or older, acting in a professional capacity. By engaging our services, you confirm you meet this requirement.

Governing law and disputes

These terms are governed by the laws of India. Any disputes arising from this engagement will be subject to the exclusive jurisdiction of the courts in Muzaffarpur, Bihar, India.
